The Local Authority Freedom of Information and Protection of Privacy Act
The Local Authority Freedom of Information and Protection of Privacy Act provides that an application for access to a record must be made to the head of the Local Authority, which City Council has designated as the City Clerk & Director of Legislative Services. The City Clerk & Director of Legislative Services must then consider the application and give written notice to the applicant within thirty (30) days of the application being made. This notice would include advisement that access to the record or part of it will be given upon payment of the prescribed fee and setting out the place where or the manner in which access will be available or, alternately, could state that access to the particular record is refused. Under those circumstances, the City Clerk & Director of Legislative Services would have to set out the reason for the refusal and identify the specific provisions in the Act on which the refusal is based. This refusal could be based on the fact that the record does not exist or perhaps that the record is exempt from access pursuant to the provisions of the Act.
This process can involve co-ordination with other civic departments, other agencies or bodies, and/or in-depth research of the corporate records by office staff.
